ORDER

The Writ Petition has been filed in the nature of Mandamus seeking a direction to the third respondent, namely, the Tahsildar, Singampunari Taluk, Sivagangai District, to consider the representation of the petitioner dated 09.03.2020 and issue patta to the petitioner for the land measuring four cents situated in S.No.797 / 18, 797/19, at Kumaripatti Village, South Singampunari Village Group, Singampunari Taluk, Sivagangai District.

2. In the affidavit filed in support of the Writ Petition, the petitioner had stated that the said five cents of land is a Government Natham land. The petitioner had approached the authorities and sought permission to enjoy the said land. The petitioner claims that the Revenue Officials orally granted him permission to occupy the said land. The petitioner claims to be in possession from the year 1980. The petitioner has stated that he has sent a representation on 09.03.2020 for seeking patta. https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. The learned Special Government Pleader, who had taken notice on behalf of the respondents, had stated that the petitioner has no vested right over the Government natham lands. It is stated that the representation of the petitioner would be considered in due course, after issuing notice to the petitioner.

4. The learned counsel appearing for the petitioner stated that the respondents are taking steps to evict the petitioner.

5. The respondents, if they are to initiate any action, are required to issue notice to the petitioner to consider the representation of the petitioner and then, pass necessary orders on the representation and then take any other steps to recover the Government natham lands. However, no such steps can be taken without issuing any notice.

6. With these observations, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
