ORDER
This writ petition is filed seeking issuance of a Writ of Mandamus to direct the respondents 1 to 3 to grant permission to conduct Maha Kumbabiseka Vila of Arul Mighu Sree Mahakaliamman 2/11
and Sree Muniyappa Samy Temple, Peterpuram, Peraiyur, Kamudhi Taluk, Ramanathapuram District, to be held on 15.03.2025 and 16.03.2025 by considering the petitioner's representations dated 03.03.2025 and 07.03.2025.
2. When the matter came up for admission, Mr.T.Lajapathy Roy, learned Senior Counsel representing Mr.M.Mahaboob Fazil, stated that the private respondents 5 to 11 have no issues with respect to the performance of Maha Kumbabishekam at the Sri MahaKaliamman temple, as the same has been constructed on a private property belonging to the members of the Devendrakula Velalar community. He stated that the dispute arises with respect to Sri Muniyappa Samy and Sri Karuppasamy deities, which are situated in the same village, but at a different location.
3. Taking note of this submission, I issued a direction permitting the petitioner to celebrate the Maha Kumbabiseka Vila of Arul Mighu Sree Mahakaliamman on 15.03.2025 and 16.03.2025.
4. Mr.Jerin Mathew and Mr.T.Lajapathy Roy submitted that both the members of the Devendrakula Velalar community and the Arunthathiyar community pray at the Sri Muniyappa Samy and 3/11
Karuppa Samy temple, but utilize the services of different poojaries. Both of them pleaded that the matter could be easily resolved, but sought time after the performance of the Maha Kumbabisekam of Arul Mighu Sree Mahakaliamman temple. Accordingly, the matter was adjourned. The parties have negotiated and have entered into a settlement. A joint memo of compromise has been filed.
5. The identities of the petitioner and the respondents 5 to 11 have been verified. All of them agreed that they would stand by the joint memo of compromise.
6. I have gone through the joint memo of compromise. I do not find anything illegal and unlawful. Hence, this writ petition is disposed of, recording the joint memo of compromise. For easy reference, the joint memo of compromise is scanned and extracted hereunder:- 4/11

7. As the matter has been compromised, the respondents 1 to 4 shall take note of the compromise and ensure that the parties stand by the compromise. No costs.
