Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to accord adequate police protection to the petitioner's life and limb while the petitioner's physical access is on the petitioner's business and the stay in the petitioner's home in pursuance to the petitioner's complaint dated 24.03.2022.

ORDER

The Writ Petition has been filed in the nature of Mandamus, seeking a direction to the respondents to accord adequate police protection to the petitioner's life and limb while the petitioner's physical access is on his business and the stay in his home in pursuance to the petitioner's complaint dated 24.03.2022. 2.The case of the petitioner is that the petitioner is facing two FIRs. One of the FIRs registered in Crime No.50 of 2022 for the offences under Sections 147, 448, 294(b), 323, 427 and 506(2) of IPC r/w Section 4 of the Tamil Nadu Prohibition of Harassment of https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD).No.6326 of 2022 Women Act and Section 3 of the Tamil Nadu Property (Prevention of Damage and Loss) Act, on the file of the third respondent. In this regard, the petitioner has filed a suit for permanent injunction in O.S.No.43 of 2022 and it is pending on the file of the District Munsif Court, Karur. Thereafter, he was granted anticipatory bail on production of surety but, again the second respondent has registered a case in Crime No.182 of 2022 for the offences under Sections 294(b), 323, 355 and 506(1) of IPC and r/w Section 3(1)(r), 3(1)(s) and 3(2)(va) of Scheduled Caste and Scheduled Tribes Amendment Act, 2015. In this regard, the petitioner was arrested and remanded to judicial custody. Subsequently, he has filed a bail petition and this Court granted bail in Crl.A.(MD)No.205 of 2022. 3.The apprehension of the petitioner is that repeatedly the respondents are registering false case as against the petitioner. The petitioner is being an accused in both the crimes, there are absolutely no circumstances warranting to provide any police protection to the petitioner.
