THE HONOURABLE MR.JUSTICE D.HARIPARANTHAMAN TR.CMP(MD)No.10 of 2015 and M.P(MD)No.1 of 2015 N.Jeganathan ... Petitioner Vs.

R.Rakila ... Respondent Petition filed under Section 24 of the Civil Procedure Code, to withdraw the HMOP.No.54 of 2011 on the file of the Sub Court, Sivakasi, and transfer the same to competent court outside Virudhunagar District. For Petitioner : Mr.S.Ramasamy

O R D E R

The petitioner is the husband. Her wife filed HMOP.No.54 of 2011 on the file of the Sub Court, Sivakasi. The petitioner has filed this petition to transfer the aforesaid HMOP to any other competent Court outside the Virudhunagar District, making a vague allegation against the Presiding Officer that he commented on a witness during the course of examination of witness.

2.It is stated that the learned Presiding Officer commented that RW3 was uttering lie. It is also alleged that when RW4 examined, the learned Presiding Officer stated that he is enacting a drama without proof. 3.If these type of allegations are entertained for transfer, then, there is no end for the same. Hence, I am not inclined to entertain this petition. Accordingly, the Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, M.P(MD)No.1 of 2015 is closed.
