ORDER : The Court Made the following order :- Petitioner/sole, who was arrested on 30.08.2016 for offences punishable under Section 8(C) r/w 20(b)(ii)(B) of NDPS Act, 1985 in Crime No.151 of 2016 on the file of respondent police, seeks bail.
2. The case of the prosecution is that petitioner was found in possession of 10 Kgs. of Ganja.
3. Learned counsel for petitioner submitted that the father of petitioner has been convicted for an offence under NDPS Act. Petitioner, who is an Engineering student studying in Nehru Institute of Technology, Coimabatore had intended to gone over to Madurai to visit his father. Whileso, false case stands foisted against the petitioner. This is second such case against petitioner. Cases are being filed repeatedly against his family members.
4. Learned Government Advocate (Crl. Side) submits that petitioner has involved in one earlier case of possession of 11⁄2 Kg of Ganja.
5. Considering the facts and circumstances of the case and also the fact that the petitioner has been in custody from 30.08.2016, this Court is inclined to release the petitioner on bail. Accordingly, the petitioner is ordered to be released on bail on her executing a bond in a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of https://hcservices.ecourts.gov.in/hcservices/
