Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of mandamus, directing the respondent no.3 to return the petitioners educational certificates i.e., 10th mark sheet, Technical Qualification certificate (Lower, and Higher) Degree incomplete mark statement and school leaving transfer certificate and certificates pertaining to business IE Code in the name of Sastha Global, TNGST Registration certificate of SOUTH INDIA FERTILIZER COMPANY, NPK manual Mixtures Manufacturing license under the joint director of Agriculture, Madurai, SALES TAX assessment filed two wheeler registration certificate to me by the way of considering the petitioner's representation dated 04.04.2017. O R D E R
The petitioner alleges wilful disobedience of an order dated 11.07.2019 in W.P.(MD).No.6812 of 2017.
2. In the said Writ Petition, the petitioner had prayed for the return of his educational certificates, technical qualification certificates and other certificates as specified in such Writ Petition.
3. After hearing all the parties, including the third respondent Bank therein, this Court concluded that the inventory submitted by the third respondent Bank, which had been signed by the Bank as well as the Village Administrative Officer concerned on 17.02.2010, did not list any of the certificates which the petitioner sought the return of. On such basis, the Writ Petition was dismissed by leaving it open to the petitioner to approach the police officials concerned in respect of the alleged missing certificates and to seek a non-traceable certificate in respect thereof. In view of the fact that the relief claimed by the petitioner had been rejected in the said Writ Petition, there is no disobedience of the relevant order and certainly no wilful disobedience thereof.
4. Therefore, Cont.P.(MD).No.939 of 2021 is closed without any order as to costs.
