ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 324 and 506(ii) of IPC, in Crime No.243 of 2016, on the file of the respondent police, seeks anticipatory bail.

2. The Case of the prosecution is that one Maharajan/A1 had a wordy quarrel in respect of murder of his brother with the defacto complainant and also attacked the defacto complainant with the help of the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Government Advocate (Criminal Side) submitted the petitioner is arrayed as A2 and he has not having any previous case and the injured is already discharged.

5.Considering the facts and circumstances of the case and also considering the fact that the injured is discharged and he is not having any previous case, I am inclined to grant anticipatory bail to the petitioner with the following condition. petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Sattur, within a period of 10 days from the date on which the order copy made ready, and on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the Trial Court daily at 10 a.m. until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
