ORDER
The petitioner has approached this Court seeking a direction to the respondent to renew his passport pursuant to the application dated 10.12.2025 bearing Application No. MD1076055874225.
2. The petitioner was earlier issued a passport in which his date of birth was recorded as 03.08.1985. Upon expiry of the validity of the said passport, the petitioner applied for re-issuance of the passport, and in the subsequently issued passport, his date of birth came to be mentioned as 02.10.1984. The validity of the said passport expired on 05.06.2026, and therefore, the petitioner submitted the present application for re-issuance of the passport.
3.However, the respondent has not processed the said application on the ground that communications had been issued to the Joint Director of Education, the Member Secretary of the Board of Secondary Education, and the Headmaster of the petitioner's school, calling upon them to furnish the School Leaving Certificate for the purpose of ascertaining the petitioner's actual date of birth. 4.In the earlier two passports issued to the petitioner, the date of birth was recorded as 03.08.1985 based on the entry found in the SSLC mark sheet. Subsequently, the passport was issued mentioning 2/5
the date of birth as 02.10.1984 based on the Aadhaar Card and PAN Card.
5.The Ministry of Home Affairs, Government of India, has issued guidelines/circulars prescribing the documents that may be relied upon for issuance of a passport and for correction of passport particulars. As per the said guidelines, documents such as the Aadhaar Card, Elector's Photo Identity Card (EPIC), Service Identity Card issued by the State or Central Government, Birth Certificate issued under the Registration of Births and Deaths Act, and other specified documents are recognized for establishing proof of date of birth.
6.In the present case, the petitioner has produced copies of the Aadhaar Card and PAN Card, both of which reflect his date of birth as 02.10.1984. These documents are recognized identity documents and constitute acceptable proof for establishing the date of birth.
7. In view of the above, this Court is of the opinion that the respondent is bound to consider the petitioner's request for reissuance of the passport on the basis of the documents produced, subject to verification in accordance with law. 3/5

Accordingly, this Writ Petition is disposed of with a direction to the respondent to consider the petitioner's request and re-issue the passport by mentioning the date of birth as 02.10.1984, subject to the petitioner satisfying all other requirements. The aforesaid exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. No costs.
