ORDER : The Court Made the following order :- Petitioner, who was remanded to judicial custody on 13.09.2016 for offences punishable under Sections 135(c) and 135(A) of Customs Act, 1962, in F.No.DRI/CZU/TTN/48/12(INT-1)2016 on the file of respondent police, seeks bail.
2.The case of the prosecution is that the petitioner was caught in his attempt to illegally export red sand of value of R.3,10,50,000/-.
3.The learned counsel for the petitioner submitted the entire contraband stands seized and the period of custodial interrogation of the petitioner is over.
4. Though the counter of the respondent informs that the petitioner is not paying the penalty in two cases of the year 2006 -2007, it is seen that the respondent had not taken steps to enforce the penalty.
5.Considering the facts and circumstances of the case, this Court is inclined to release the petitioner on bail. Accordingly, the petitioner is ordered to be released on bail on his executing a bond in a sum of Rs.10,000/-(Rupees ten thousand only) with two https://hcservices.ecourts.gov.in/hcservices/
