O R D E R
The petitioner is before this Court seeking a direction to the second respondent to disburse the amount available in Account No. 035801000050577 to all the legal heirs of the deceased, Abdul Razak, S/o. Mohamed Mohideen.
2. The said Abdul Razak, husband of the petitioner, died leaving behind the petitioner, the third respondent, one son, and one daughter as his legal heirs. The second respondent is a scheduled bank. It is stated that there is a dispute among the legal heirs regarding the disbursement of the amount lying in the account of the deceased. 3.In view of the above, this Court is of the opinion that such 2/4
disputed questions of fact cannot be adjudicated in exercise of its writ jurisdiction.
4. Accordingly, this writ petition is dismissed as not maintainable, with liberty to the petitioner to approach the jurisdictional civil court for appropriate relief.
