ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The present writ petition has been filed for the following relief: " To restrain the respondents no.1 to 3 from remove the encroachment in Survey No. 161/2 in Maynoor Village, Krishnarayapuram Taluk, Karur district without following the provisions of the Tamilnadu Encroachment Act, 1905.

2. The writ petition is nothing but abuse of process of law. The affidavit and the representation sent by the petitioner clearly indicate that he is also aware of the proceedings under the Tamil Nadu Land Encroachment Act, 1905, against which he has also filed an appeal under Section 10 of the Act before the District Collector.

3. In such view of the matter, the contention that the proceedings have been initiated against the writ petitioner without following due 2/4

process of law is nothing but falsehood. Only to drag on the proceedings, he has filed this writ petition. Hence, we do not find any merits in this writ petition.

4. With the said observations, this Writ Petition is dismissed. However, it is open for the petitioner to work out his remedy before the Appellate Authority/District Collector, where, admittedly, he has filed the appeal. The Appellate Authority shall expedite his appeal. No costs. Consequently, connected miscellaneous petition is closed.
