Respondent, the court made the following order:- [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] On perusal of records, we find that the earlier application for suspension of sentence has been moved in Crl.M.P.(MD).No.11572 of 2022. After arguments and finding that this Court was not inclined to grant suspension of sentence, the learned counsel for the petitioners sought permission to withdraw the petition and has also withdrawn the same.
2. The present petition for suspension of sentence is pending from March 2023. Since the main appeal itself is ready for final hearing, considering suspension of sentence is not required at this stage and it would be appropriate to list the main appeal for final hearing. Hence, the Criminal Miscellaneous Petition is dismissed.
3. Registry is directed to list the main appeal for final hearing in the usual course.
