: Respondents Prayer:Criminal Original Petition is filed under Section 482 of Cr.P.C., praying to direct the 2nd respondent not to harass the petitioner demanding him to discharge the debt amount in terms of cash under the guise of enquiry based on an information preferred by one Sujatha Subburayan.

Heard the learned counsel for the petitioner; learned Government Advocate (Criminal side) appearing for the respondents and perused the materials placed on record.

2. Mr.S.Pitchaiah, Sub Inspector of Police, District Crime Branch, Tuticorin is present in Court today. On instructions, the learned Government Advocate (Criminal side) submitted that, on the complaint given by one Sujatha Subburayan against the petitioner, a petition enquiry was conducted and the same was closed on the undertaking given by the petitioner that he will settle the matter before 30.04.2017 with the defacto complainant.

3. In such circumstances, the petitioner is directed to participate in the enquiry and during enquiry, they shall not be harassed. During the course of enquiry, if any cognizable offence is made out, the second respondent is free to register an FIR and this order shall not be a shield for the petitioner against arrest.
