PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 1st respondent to transfer the complaint from the 2nd respondent to any other investigating officer within his jurisdiction.

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the 1st respondent to transfer the complaint from the 2nd respondent to any other investigating officer within his jurisdiction.

2. The learned Additional Public Prosecutor would submit that based upon the complaint given by this petitioner against Mohammed Abdullah and others, enquiry was undertaken and notice was also issued to both the parties.

3. Perusal of enquiry file shows that the above said Mohammed Abdullah appeared for enquiry before the second respondent Police and gave a statement that he has not demolished the compound wall. But further enquiry is kept pending.

4. The second respondent is directed to visit the place of occurrence, file a proper mahazar and as well as make enquiry to find out whether any demolition has been taken place. The second respondent is 2/4

further directed to complete the above said enquiry process within a period of one month from the date of receipt of copy of this order. Depending upon the outcome of the above said enquiry, the parties and as well as the competent authority may take further steps.

5. With the above said direction and liberty, this Criminal Original Petition is disposed of.
