ORDER : The Court Made the following order :- Petitioner/A1, who was arrested on 14.09.2016 for offences punishable under Sections 376, 302 and 201 IPC in Cr.No.93 of 2015 on the file of respondent police, seeks bail.
2. The case of the prosecution is that the accused persons raped one Gayatri and murdered her by set on fire and with the help of other villagers, they disposed of the dead body without disclosing the real facts.
3. Learned counsel for petitioner submitted that the occurrence is said to have taken place on 03.01.2014 and the case has been registered on 10.04.2015 and due to property dispute, the defacto complainant preferred a false complaint to prevent the petitioner to inherit the properties.
4. Learned Government Advocate (Crl.Side) submits that petitioner was arrested when he returned to India and the investigation is pending.
5. Considering the facts and circumstances of the case and and the submissions made, this Court is inclined to release the petitioner on bail. Accordingly, the petitioner is ordered to be released on bail on his executing a bond in a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of learned Judicial Magistrate No.II, Sivagangai https://hcservices.ecourts.gov.in/hcservices/
