ORDER : The Court Made the following order :- Petitioner/A1, who was arrested and remanded on 21.08.2016, for offences punishable under Sections 341, 294(b), 387, 307 and 302 IPC in Cr.No.167 of 2010 on the file of respondent police, seeks bail. 2.The case of the prosecution is that due to previous enmity, the petitioner along with other accused restained, scolded and assaulted the deceased with deadly weapons, thereby caused death. 3.Learned counsel for the petitioner submits that owing to nonappearance, Non Bailable Warrant stands issued on 14.06.2016. 4.Learned Government Advocate (Crl.Side) submits that the petitioner has no previous case and the case was committed to the Sessions Court and the case is pending in S.C.No.35 of 2012. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the facts and circumstances of the case, this Court is inclined to release the petitioner on bail. Accordingly, the petitioner is ordered to be released on bail on his executing a bond in a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for the like sum to the satisfaction of the Principal District and Sessions Judge, Kanyakumari District at Nagercoil, Kanyakumari District, and on condition that the petitioner shall be required to appear before the Sessions court for all hearings except where his presence is dispensed with under Section 317 Cr.P.C. sd/- 28/09/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
