O R D E R
This writ petition has been filed by the petitioner to direct the respondents to consider the petitioner's representation dated 02.01.2025 seeking to remove the petitioner's name from the History Sheet No.689 of 2016 on the file of the 2nd and 3rd respondents.
2. According to the petitioner, the 3rd respondent has created a history sheet in H.S.No.689 of 2016 and the same is pending. Already, there were some case pending against the petitioner and the same were disposed of in the year 2021 itself. Thereafter, no any case is pending against the petitioner. However, the 3rd respondent is arrayed as one of the accused in Crime No.477 of 2024 and the same was already quashed by this Court through an order in Crl.O.P(MD).No.15105 of 2024 dated 30.09.2024. Even after that, still the petitioner's name is pending in the History Sheet No.689 of 2016. Therefore, the petitioner sent a representation dated 02.01.2025, but the same has not been considered. Hence this petition.
3. The learned Additional Public Prosecutor (Criminal Side) appearing for the respondents no.1 to 3 would submit that earlier, due to Page No. 2 of 4
pendency of cases against the petitioner, they opened a history sheet in H.S.No.689 of 2016 as against the petitioner and thereafter, already all the cases were disposed of. Last year, this Court quashed the case in Crime No.477 of 2024 through an order dated 30.09.2024 and thereafter, no case is pending against the petitioner. They also received the representation of the petitioner dated 02.01.2025 and the same will be considered within fifteen days.
4. Since the representation of the petitioner is pending with the 1st respondent, this Court directs the 1st respondent to consider the representation of the petitioner dated 02.01.2025 and pass appropriate order by taking into consideration of disposal of all the cases pending against the petitioner within a period of fifteen [15] days from the date of this Order.
5. With the above said observations and directions, this writ petition is disposed of. No costs.
