ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 10.01.2016 for the offences punishable under Sections 366(A), 376 I.P.C. r/w Section 5(L) r/w 6 of POCSO Act, 2012 and Section 3(2)(v) of SC/ST (POA) Amendment Ordinance Act 1989 in Crime No.349 of 2015, on the file of the respondent police, seeks bail.
2. Heard the learned Counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.
3. On 22.02.2016, this Court granted interim bail to the petitioner. When he was in interim bail, he lodged a complaint dated 14.04.2016 to the respondent police, wherein he has stated that he is willing to marry the victim girl and requested the police to give protection for their marriage.
4. The learned Government Advocate(Crl.Side) submitted that on the complaint given by the petitioner, the respondent police conducted enquiry and recorded the statement of the victim girl. The victim girl stated that she is not willing to marry the petitioner. He also submitted that final report has been filed on 20.04.2016 before the learned Judicial Magistrate, Rajapalayam.
5. In view of the above, the interim bail already granted to the petitioner is made absolute. As regards the condition, since final report has been filed, the condition to report before the respondent police is relaxed.
