ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, in Crime No.374 of 2016 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323 and 506(ii) of IPC and hence, seeks anticipatory bail.
2.The learned counsel appearing for the petitioner states that the defacto complainant and two others came by one two-wheeler and dashed against the vehicle of the petitioner and caused injury to the petitioner herein and hence, he preferred a complaint against the defacto complainant and a case was registered in Cr.No.371 of 2016, dated 28.12.2016. The present complaint is a counter-blast complaint of the complaint given by the petitioner against the defacto complainant herein.
3.The learned Government Advocate(Crl. Side) appearing for the respondent states that the petitioner attacked the defacto complainant with hands and no injury is caused. 4.Considering the facts and circumstances of the case and also considering the fact that no-body is injured in the alleged occurrence, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Ilayangudi and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand https://hcservices.ecourts.gov.in/hcservices/
only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
