For Respondent : Mr.R.Erottuchamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.18 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as accused, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 457 and 393 IPC, in Crime No.18 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 23.03.2021 the defacto complainant was sleeping in her house at about 1.00 a.m. the petitioner said to have illegally trespassed into her house and snatched her two sovereigns of gold chain. Since she has raised noise, her husband and the persons nearby resident woke up and tried to catch the petitioner, but he escaped from there. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner did not commit any offence as alleged by the respondent police and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

CRL OP(MD).No.5857 of 2021 4.The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the petitioner is a habitual offender and he is having seven previous cases to his credit. Hence, he strongly opposed to grant anticipatory bail to the petitioner. 5.Taking into consideration the facts and circumstances of the case and also taking note of the fact that the petitioner has committed serious offence of house trespass and attempted to commit robbery and also he has seven previous cases pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.
