Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A6 & A7, in Crime No.11 of 2016 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 420, 120(b) IPC and Section 5 of TNPID Act and hence, seek anticipatory bail.

2.Heard the learned counsel for the petitioners and the learned Government Advocate(Crl. Side) for the respondent/State. 3.The learned Government Advocate appearing for the State submitted that out of a total sum of Rs.8 lakhs, the petitioners have deposited only a sum of Rs.6 lakhs and the remaining amount of Rs.2 lakhs has to be deposited.

4.Considering the facts and circumstances of the case and also considering the fact that the petitioners have already deposited nominal amount, this Court is inclined to grant anticipatory bail to https://hcservices.ecourts.gov.in/hcservices/

the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Special Court under the Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997, Madurai and on each executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further conditions that the petitioners shall deposit Rs.1 lakh (Rupees one lakh) each to the credit of Special Court under the Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997, Madurai in Crime No.11 of 2016 and shall appear before the respondent police once in a week i.e, on every Monday, at 10.30 a.m., for a period of eight weeks and thereafter, as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

5.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
