Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents to issue patta in petitioner's name for the punja land measuring 33 cents (13.5 ares) in survey no.275/2 situated at Melaiyagoundanpatti village, Nilakottai taluk, Dindigul district by considering petitioner's patta transfer vide CAN No. 133241630009412 and Application No. 2025/0/03/13/392737 dated 21.07.2025.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to issue patta in petitioner's name for the punja land measuring 33 cents (13.5 ares) in survey no.275/2 situated at Melaiyagoundanpatti village,

Nilakottai taluk, Dindigul district by considering petitioner's patta transfer vide CAN No. 133241630009412 and Application No.2025/0/03/13/392737 dated 21.07.2025. 2.The contention of the petitioner is that originally, one Pichaipillai was the owner of the property. After his demise, his wife Kamalathammal and his two minor daughters Abhinaya and Saktheeswari jointly inherited the property and they jointly enjoyed the property until 30/07/2003. Thereafter, the said Kamalathammal and her two minor daughters sold the property to one Anandsamiyar through registered Sale Deed Document No.1323 of 2003. The said Anandsamiyar was in possession and enjoyment till his lifetime but without transferring the patta in his name. After his demise, his mother K.

Muneeshwari inherited the land because the said Anandsamiyar was unmarried till his death and he had no issues. The said K.Muneeshwari was in possession and enjoyment without transferring the patta. On 11/11/2009, the said K.Muneeshwari sold the property to one M.Athichamy through registered sale deed in Document No.3702 of 2009. Then, the said M.Athichamy was in possession and enjoyment without transferring patta in his name till 16/12/2013. Thereafter, on 16/12/2013, the said M.Athichamy sold the property to the petitioner through registered Sale Deed Document No.4115 of 2013. Subsequent to the purchase, the petitioner was in possession and enjoyment of the property.

considered. Finally, the petitioner submitted an online application, dated 21.07.2025 in CAN No.133241630009412 and the same is pending. Therefore, the petitioner is seeking Mandamus directing the respondents to issue patta based on the registered document No.4115 of 2013.

3.Therefore, the respondents are directed to consider the petitioner's online application after perusing the documents and the three parent documents / sale deeds and thereafter, pass appropriate orders in accordance to law. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
