Respondent Prayer: Petition is filed under Section 24 of C.P.C., to withdraw and transfer the divorce case in O.P.No.2934 of 2015 on the file of the Principal Family Court No.III, Chennai to Family Court, Madurai wherein maintenance case in M.C.No.130 of 2015 is filed by the petitioner.

ORDER

A petition filed by a wife to transfer O.P.No.2934 of 2015 from the III Principal Family Court, Chennai to Family Court, Madurai. 2.Substituted service through paper publication is effected. Proof filed. Name of the respondent is printed in the cause list. Neither he nor any one appeared for him.

3.The petitioner had married the respondent in 2008. They are having 2 children. They are studying in a school in Madurai. Due to difference of opinion, respondent filed O.P.No.2934 of 2015 in the Family Court, Chennai. The petitioner is now living in Madurai along with her children. They are under the care and custody of her parents. Going to Chennai to face her husband's case will put her to lot of inconvenience expenses.

4.In the circumstances, we accept the submission of the learned counsel for the petitioner for transfer.

5.In the result, this transfer petition is allowed. H.M.O.P.No.2939 of 2015 pending on the file of the III Additional Family Court, Chennai, is transferred to the Family Court, Madurai. No costs.
