Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus directing the respondents to approve the appointment of the petitioner as Junior Assistant with effect from 09.10.2017 by considering the proposal submitted by the 5th respondent on 09.10.2017 and to disburse all the monetary and service benefits consequent to the same from 09.10.2017 within a time frame that may be fixed by this Hon'ble Court.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.S.SRIMATHY, Special Government Pleader for the petitioners 1 to 4 and the respondent not appeared either in person or by an advocate, the court made the following order:- (Order of the Court was made by M.DURAISWAMY,J) There is a delay of 238 days in filing the Writ Appeal.
2. Though notice was served on the sole respondent and her name has been printed in the cause list, none appeared for her.
3. Though the petitioners have satisfactorily explained the reasons for the delay, since the delay is on higher side, in the interest of justice, the same can be condoned on payment of costs. Accordingly, the delay of 238 days in filing the writ appeal is condoned on condition the petitioners paying a sum of Rs.500/- (Rupees Five Hundred only) to the Honourable Chief Justice Relief Fund within a period of two weeks from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without further reference to this Court.
4. Accordingly, this petition is ordered.
