For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.91 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 342, 506(ii) IPC and Section 25(1)(a) Arms Act, in Crime No.91 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that on 13.03.2022, when the defacto complainant and his friends were consuming liquor under the water tank near Janakiammal Hospital, the petitioner along with other accused persons came to that occurrence place, at that time there arose wordy quarrel between petitioner and the defacto complainant, due to which, the petitioner threatened the defacto complainant and attacked the him and his friends with knife. Hence, the complaint.

CRL OP(MD). No.6511 of 2022 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Criminal Side) appearing for the respondent would submit that the injured was discharged from the Hospital and that the petitioner is having five previous cases and the same are pending, out of which, one case is similar in nature. He would further submit that the investigation is pending in connection with the present case.

5.Considering the seriousness and gravity of the offence alleged and also the fact that the investigation is pending as stated by the learned Government Advocate (Criminal Side), this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 07/04/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
