To return the original documents mentioned in the petition produced as additional evidence along with C.M.P.(MD) No. 13149 of 2023 in the above appeal in S.A.(MD) No. 99 of 2017 and thus render justice.

ORDER

3.The petitioner filed C.M.P.(MD)No.13149 of 2023, pending Second Appeal before this Court, seeking to file additional evidence, invoking Order 41 Rule 27 of CPC. This Court dismissed the said application and proceeded to non-suit the petitioner / appellant by dismissing the Second Appeal. The petitioner now seeks for return of the original documents that were filed and sought to be marked as additional evidence.

4.In view of the fact that the said C.M.P.(MD)No.13149 of 2023 was dismissed, there can be no impediment for the petitioner to seek return of the said original documents.

5.Accordingly, this Civil Miscellaneous petition is allowed. 6.Registry is directed to return those originally documents to the petitioner / appellant, retaining a photocopy of the same. 20-04-2026 MR To
