JUDGMENT

The appellant, who was arrested on 19.04.2018, for the offences punishable under Sections 9(a) (I) 9(m) r/w 10 of POCSO Act 2012 and 341, 506(1) IPC and Section 3(1) (r) (i) of SC/ST (POA) Act, 2015 in Crime No.21 of 2018 on the file of the respondent police, seeks bail.

2.The appellant has filed a petition in Cr.M.P.No.579 of 2018 before the learned Sessions Judge, Fast Track, Mahila Court, Ramanathapuram, Ramnad District and the same was dismissed on 11.05.2018. As against the same, the appellant has filed the present Criminal Appeal for the above said relief.

3.The case of the prosecution is that the petitioner is said to have sexually harassed the defacto complainant's minor daughter, who is belonging to the scheduled caste.

4.The learned counsel for the appellant submitted that the appellant is an innocent person and he has been falsely implicated in this case.

5.The learned Government Advocate (Crl. Side) appearing for the State submitted that investigation is still pending. 6.Considering the facts and circumstances of the case and also taking note of the period of incarceration of the appellant, I am of the view that the appellant could be enlarged on bail. Accordingly, the Criminal Appeal is allowed and it is ordered that the appellant shall be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Fast track, Mahila Court, Ramanathapuram, Ramnad District and on further condition that the appellant shall report before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation.
