Respondents Prayer : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure praying to direct respondents No.1 and 2 to consider the petitioner's representation dated 23.04.2017 and to give adequate police protection to the petitioner (A.Ramachandran) at the time of the petitioner participate in the tender schedule's as called for by the Tamil Nadu Housing Board, Madurai Circle, Ellis Nagar, Madurai-625 016 dated 27.04.2017 and 28.04.2017 for their life and liberty within the time frame fixed by this Court.

O R D E R

It is the case of the petitioner that he wants to participate in the open tender that is going to be held on 27.04.2017 at 03.00 p.m and 28.04.2017 at 11.00 a.m. by the Tamil Nadu Housing Board, Ellis Nagar, Madurai-16 and that the petitioner apprehends that he will not be permitted to participate in the tender by a group of vested people, who are the contractors by not permitting any outsiders to freely participate in the tender.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondents 1 and 2.

3. Today Mr.T.Pandi, Special Sub Inspector of Police, C-3, S.S.Colony Police Station, Madurai is present.

4. In the opinion of this Court, when a public tender is called, every Indian Citizen must be in a position to freely participate in the tender, if he has no legal dis-qualification. It is the duty of the police to ensure that the tender is conducted in a free and fair manner. Therefore, this Court directs the second respondent police to afford sufficient protection to the petitioner no harm befalls him.
