PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned notice issued by the fourth respondent in his proceedings No.nil dated nil and signed on 16.02.2026 and quash the same and consequently directing the respondents 1 to 4 to issue patta in favour of the petitioner pertaining to the property in Survey No.21/1 with an extent of 0.01.20 hectare situated at Kavanur Village, Thiruppathur Taluk, Sivagangai District based on the petitioner's representation dated 25.02.2026.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) Challenging the impugned notice issued by the fourth respondent dated 16.02.2026, the petitioner has filed the present Writ Petition seeking to quash the same and for a consequential direction to respondents 1 to 4 to issue patta in favour of the petitioner in respect of the 2/6

property in Survey No.21/1, measuring an extent of 0.01.20 hectare, situated at Kavanur Village, Thiruppathur Taluk, Sivagangai District, based on the petitioner's representation dated 25.02.2026. 2.The grievance of the petitioner is that she is in possession and enjoyment of the property in Survey No.21/1 and that action has now been initiated against her by issuing a notice under Section 7 of the Tamil Nadu Land Encroachment Act.

3.Heard the learned counsel appearing on either side and perused the materials available on record.

4.On perusal of the materials available on record, it is seen that by proceedings dated 08.08.2020, the third respondent issued patta to five persons who were already occupying the land in Survey Nos.21/2, 21/3, 21/4, 21/5 and 21/6. The present issue relates only to Survey No.21/1, which is classified as Government land. The petitioner has already obtained patta in respect of the house site. However, she has now challenged the notice issued 3/6

in respect of the Government land, which is said to be in her occupation. 5.In such circumstances, it is for the petitioner to submit a proper explanation in response to the notice issued by the concerned authority. Upon receipt of the explanation, the authority concerned shall consider it and pass appropriate orders based on the merits and in accordance with the law, as expeditiously as possible. 6.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
