O R D E R
This Writ Petition has been filed seeking a writ of mandamus directing the respondents 1 and 2 to consider the petitioner's representation, dated 15.12.2023 seeking for revision of pensionary benefits with reference to G.O.No.62, dated 09.03.2015.
2. Heard the learned counsel for the petitioner, the learned Government Advocate for the respondents and perused the materials available on record.
3. The petitioner, who worked as Secondary Grade Teacher retired on 31.05.2005. On 11.01.1988, a sum of Rs.1,055/- was assigned as yearly increment to him. Thereafter, as per G.O.Ms.No.304, dated 28.03.1990, a sum of Rs.1,500/- has been fixed as yearly increment. In G.O.Ms.No.62, dated 09.03.2015, it has been ordered that Secondary Grade Teachers are entitled to count services rendered on identical scales of pay prior to 01.06.1988. Accordingly, the petitioner is eligible to revise the scale of pay in the ratio of Rs.2500-60-2300-75-3200. The third respondent also recommended for revision of scale pay of the petitioner. To ventilate his grievance, he approached the respondents 1 and 2 on several occasions. Finally, he sent a representation, dated 15.12.2023 to the respondents. But there was no reply from them. 2/5
Aggrieved by the inaction of the respondents, the present writ petition has been filed.
4. Considering the relief sought in this writ petition is with regard to dispose of his representation, dated 15.12.2023 only, in my considered opinion, it is appropriate and reasonable to dispose of this writ petition at the stage of admission with the consent of both parties without going into the merits of the case with a direction to the first respondent to consider the representation, dated 15.12.2023 of the petitioner within a stipulated time to meet the ends of justice.
5. Accordingly, the writ petition is disposed of with a direction to the first respondent to consider the representation, dated 15.12.2023 of the petitioner and pass appropriate order in accordance with law within a period of three weeks from the date of receipt of a copy of this order. No costs.
