ORDER : The Court Made the following order :- The petitioners/A2 and A3 apprehend arrest at the hands of the respondent police for the alleged offences under Section 328 of IPC and Sections 6 (a), 6 (b) and 24 (1) of the Cigarettes and other Tobacco Products Acts, 2003 in Crime No.242 of 2018 and seek anticipatory bail.
2.The learned counsel for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. 3.The learned Government Advocate (Criminal side) submitted that on the basis of secret information, on 12.04.2018, the respondent police conducted search at the house of the first accused and seized prohibited Tobaccos in the presence of the official witnesses and based on the confession made by him, the present petitioners are arrayed as A2 and A3 in this case. He further submitted that the said Tobacco products have been recovered. 4.Taking note of the above facts and circumstances, this Court is inclined to grant the relief of anticipatory bail to the petitioners.
5.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the https://hcservices.ecourts.gov.in/hcservices/
learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Madurai, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m. for two weeks and thereafter, as and when required for interrogation.
