BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 12.02.2015 CORAM :
THE HONOURABLE MR.JUSTICE D.HARIPARANTHAMAN TR.CMP(MD)No.41 of 2015 and M.P(MD)No.1 of 2015 1)Duraiarasen 2)Poyamozhi ... Petitioners Vs.
1)Pandian 2)Tmt.Saraswathiammal ... Respondents Petition filed under Section 24 of the Civil Procedure Code, to withdraw the case in O.S.No.59 of 2014 on the file of the District Munsif Court, Paramakudi, Ramanathapuram District, and transfer the same to any other Court exercising the same jurisdiction for further proceedings in accordance with law.
For Petitioners : Mr.F.Deepak
O R D E R
The petitioners are the plaintiffs in O.S.No.59 of 2014 on the file of the District Munsif Court, Paramakudi, Ramanathapuram District. The 1st defendant in the suit is an advocate that is the sole reason according to the plaintiffs for transfer of the suit.
2.In my view, that cannot be the reason to transfer the suit. Further, the learned counsel has brought to my notice to FIR in Crime No.12/2014 on the file of Land Grabbing Special Cell, Ramanathapuram, and another FIR in Crime No.147/2014 on the file of Nainarkovil Police Station, Ramanathapuram, registered against the 1st respondent. However, it has nothing to do with the proceedings in O.S.No.59 of 2014. Hence, the Transfer Civil Miscellaneous Petition is dismissed. No costs. M.P(MD) No.1 of 2015 is closed.
