ORDER

This Civil Revision Petition has been filed seeking for a direction to the Sub Court, Periyakulam, Theni to dispose of the case in O.S.No.32 of 2021, within the time frame.

2. The grievances of the petitioner is that the fourth respondent is an Advocate. He is practising before the trial Court and he has dragged on the proceedings before the trail Court. He has also produced the Bdiary extract before this Court, wherein it shows that on 05.01.2022, the case has been posted and issues have been framed. On 09.02.2022, the case was posted for trial and again on 09.03.2022, the case is posted for trial and thereafter, the trial is not commenced. 3.Heard the learned counsel appearing for the petitioner. Though notice served on the respondent and also name printed in the cause list, there was no representation for the respondent. 2/4

4.It is seen from the records that the respondents had filed the suit in O.S.No.32 of 2021 on the file of the Sub Court, Periyakulam, Theni and the case was repeatedly posted for trial, even then there was no development in the suit for the past one year. 5.Taking into consideration the facts and circumstances of this case and also the fact that the suit is pending for nearly one year without any progress, there shall be a direction to the learned Sub Court, Periyakulam, Theni, to dispose of the suit in O.S.No.32 of 2021, within a period of eight months from the date of receipt of copy of this order. This Civil Revision Petition is disposed of with the above direction. No Costs.
