Prayer: Petition filed under Section 438 of the Criminal Procedure Code, to direct the respondents No.1 & 2 to provide adequate police protection to the petitioner against the life threat perceived from the 3rd respondent on the basis of the petitioner's complaint dated 01.06.2020 and 04.06.2020.

ORDER

This petition is filed for a direction to the respondent Police to provide adequate police protection to the petitioner. 2.When the matter is taken up for hearing today, the learned Additional Public Prosecutor, on instructions, submits that based on the complaint of the petitioner, the third respondent/petitioner's son was called and enquired in a Police Station in C.S.R.No.161 of 2020. During the enquiry, the third respondent, the son of the petitioner, gave two undertakings that he would shift his residence from the ground floor to the first floor for enabling the petitioner to occupy the ground floor and also undertook that he would not cause any inconvenience to his father, the petitioner. Recording the undertakings given by the third respondent Kannan, the complaint was closed and pursuant to the undertaking given by the third respondent, the petitioner has also given a statement that he would withdraw the complaint. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD)No.5814 of 2020 3.The learned counsel appearing for the petitioner even then reiterates that the petitioner is aged about 76 years and the third respondent and his wife are harassing him. As and when any new cause of action arises, it is always open to the petitioner to file necessary application for a direction under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. 4.Accordingly, this criminal original petition is disposed of.
