Respondent Prayer: Petition is filed under Section 24 of C.P.C., to withdraw the case in H.M.O.P.No.192 of 2015 pending on the file of the learned Subordinate Judge, Thoothukudi and transfer the same to any of the competent Court at Sivagangai, more particularly to the file of the learned Family Court, Sivagangai. ORDER

This petition is filed by the petitioner who is non other than the wife of the respondent seeking the relief of withdrawal of matrimonial proceedings in H.M.O.P.No.192 of 2015 from the file of the learned Subordinate Judge, Tuticorin and transfer the same to the file of any competent court at Sivagangai District. 2.It appears that the petition in H.M.O.P.No.192 of 2015 was filed by the respondent seeking the relief of divorce on the file of the learned Subordinate Judge, Tuticorin. The petitioner has entered appearance before the Subordinate Judge, Tuticorin, where the petition in H.M.O.P.No.192 of 2015 is pending. Now the petitioner has stated that she finds it difficult to travel to Tuticorin for the purpose of attending the matrimonial proceedings all along from Sivagangai District and on the sole reason she has filed this petition for transferring the matrimonial proceedings in H.M.O.P.NO.192 of 2015.

3.When the petition came up for hearing, the learned counsel appearing for the respondent has suggested that instead of transferring the matrimonial proceedings in H.M.O.P.No.192 of 2015 to any one of the competent court in Sivagangai District, it may be transferred to the Family Court, Madurai. The learned counsel for the petitioner has also conceded and he has also suggested that the petition in H.M.O.P.No.192 of 2015 may be transferred to Family Court, Madurai.

learned counsels, the matrimonial proceedings in H.M.O.P.No.192 of 2015 is ordered to be withdrawn from the file of the learned Subordinate Judge, Tuticorin and transferred to the file of Family Court, Madurai for disposal in the manner known to law. No costs. Consequently, connected M.P.is closed.
