RESPONDENT/CLAIMANT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time granted by this Hon'ble Court in C.M.P(MD) No. 1448 of 2020 in C.M.A.(MD) No.83 of 2020 dated 12.02.2020 for further period of eight weeks and thus render justice.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.M.VISHNUVARTHANAN, Advocate for the petitioner while admitting the civil miscellaneous appeal the court made the following order:- This petition is filed to extend the time granted in C.M.P.(MD) No.1448 of 2020 in C.M.A.(MD)No.83 of 2020, dated 12.02.2020.
2. Heard the learned counsel appearing for the petitioner.
3. This Court has already granted interim order in C.M.P.No.1448 of 2020, dated 12.02.2020 and directed the appellant / Tamilnadu State Transport Corporation, to deposit 50% of the award amount with proportionate interest and costs to the credit of Motor Accident Claims Tribunal / Subordinate Court, Ramanathapuram, in M.C.O.P.No.17 of 2017, within a period of eight weeks from the date of receipt of a copy of that order. Now the appellant / Tamil Nadu State Transport Corporation requests further time to deposit the https://hcservices.ecourts.gov.in/hcservices/
CMP(MD) No.3295 of 2020 said amount.
4. I am of the view that interim order has been passed even much prior to the announcement of the lock-down period and the reasons stated in the affidavit is not acceptable.
5. In view of the above, this Court is not inclined to extend the time and the Appellant/Tamil Nadu State Transport Corporation is directed to deposit 50% of the award amount with proportionate interest and costs to the credit of Motor Accident Claims Tribunal /Subordinate Court, Ramanathapuram, in M.C.O.P.No.17 of 2017, immediately on or before 19.06.2020, failing which, interim order granted by this Court dated 12.02.2020 shall stand automatically vacated without any further reference.
