JUDGMENT

This writ appeal is preferred by the Inspector of Police, Civil Supplies Crime Investigation Department, Thanjavur, who is the third party in the Writ Petition, as against the order, dated 19.09.2013 passed in W.P(MD)No.15492 of 2013,.

2. The said Writ Petition was filed by the first respondent/writ petitioner to issue a Writ of Mandamus, directing

the second respondent to release the lorry bearing Registration No.TN-49-AT-3180 seized by the Inspector of Police, Civil Supplies CID, Tanjore, Tanjore District on 03.08.2013 to the petitioner.

3. While passing order, dated 19.09.2013, the learned Single Judge of this Court directed the respondent to release the first respondent/writ petitioner's vehicle, by following certain conditions. One of the condition is that if the vehicle in question is in custody of the criminal Court, it is open to the first respondent/writ petitioner to approach the concerned Court to get release of the vehicle by filing appropriate application. If the vehicle is in the custody of the respondent, namely, the District Revenue Officer, Pudukottai, the order is to be complied with within three days.

4. Heard the learned counsel appearing on either side and perused the materials available on record.

5. It is now stated that the vehicle itself had been released as early as on 30.09.2014 and therefore, nothing survives for adjudication in the Writ Appeal.
