Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 2nd respondent herein to grant patta in favour of the petitioner for the properties comprised in Survey No.28/9 to an extent of 32/1A1/B to an extent of 0.00.60 Ares in Natham House Site Patta No.390, situated at Keeladi Village, Thiruppuvanam Taluk, Sivagangai District (Previously Pasumpon Muthuramalinga Thevar District), based on the petitioner's representation dated 10.02.2021, within a stipulated time fixed by this Court.

ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the 2nd respondent to consider the representation made by the petitioner on 10.02.2021, wherein, the petitioner has sought for grant of patta in his name with respect to the subject property.

2. The case of the petitioner is that the subject property originally belonged to his aunt and she executed a Will in favour of the petitioner on 10.03.1993. The further case of the petitioner is https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. The petitioner made a representation before the 2nd respondent on 10.02.2021 seeking for patta in his name with respect to the subject property. Since the same was not considered, the present writ petition has been field before this Court.

4. Heard Mr.K.Malaimaran, learned counsel for the petitioner and Mr.M.Rajarajan, learned Additional Government Pleader, appearing on behalf of the respondents.

5. Taking into consideration the facts and circumstances of the case and the relief sought for in the writ petition, there shall be a direction to the second respondent to consider the representation made by the petitioner on 10.02.2021 on its own merits and pass orders strictly in accordance with law within eight weeks from the date of receipt of a copy of this order.

6. The petitioner is directed to make a fresh representation to the second respondent enclosing all the relevant documents along with a copy of this order.

7. This writ petition is disposed of with the above direction. No costs.
