To set aside the judgment and decree passed by the Hon'ble District Court, Nagercoil in A.S.No.81 of 2014 dated 24.04.2018 by modifying the judgment and decree of the Hon'ble II Additional Sub Court, Nagercoil in O.S.No.34 of 2013 on 26.08.2014, and dismiss the suit.

CMP(MD) No.1465 of 2019 This petition has been filed by the petitioners seeking to condone the delay of 135 days in filing the Second Appeal.
2. Heard the learned counsel for the petitioners, the learned counsel appearing for the first respondent and the learned Special Government Pleader appearing for the second respondent. 3.Considering the reasons stated in the affidavit filed in support of the petition and considering the length of delay, this Court is inclined to condone the delay subject to the payment of cost of Rs.500/- (Rupees five hundred only) to the Adyar Cancer Institute, Adyar, Chennai, through online payment within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without any further reference to this Court.
