O R D E R

This Writ Petition is filed seeking a direction to the respondents to grant patta in respect of the property situate in Survey No.179 in Thavasimadai Village, Dindigul East Taluk, Dindigul District, with an extent of 60 cents, by considering his representation dated 04.01.2023.

2. Heard the arguments of Mr.M.Mohamed Sherbudeen, learned counsel for the petitioner, Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 and 2 and Mr.A.Baskaran, learned Additional Government Pleader appearing for the third respondent.

3. According to the petitioner, the subject property have been in possession and enjoyment of the petitioner's family for several years right from the days of his grandfather. Based on their long possession, the petitioner submitted a representation on 04.01.2023, seeking issuance of patta. The same has not been considered. Hence, the petitioner has come before this Court.

The learned Additional Government Pleader appearing for the respondents would submit that the second respondent can consider the request of issuance of patta in Natham land only in respect of 3 cents and hence, the petitioner's request has not been considered. It is also stated that if the request of issuance of patta is more than three cents, the competent authority is the Commissioner of Land Administration.

5. In view of the same, the petitioner is directed to submit a fresh representation to the Commissioner of Land Administration, Ezhilagam, Chepauk, Chennai 600 005 within a period of two (2) weeks from the date of receipt of a copy of this order. On submission of representation, the said authority shall consider the same and pass final orders on its own merits, within a further period of twelve (12) weeks.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
