PETITIONERS/ ACCUSED RANK NOT KNOWN Vs STATE REP.BY THE INSPECTOR OF POLICE, ALL WOMEN POLICE STATION, TALLAKULAM, MADURAI CITY, IN (CRIME NO. NOT KNOWN OF 2017) ... RESPONDENT/ COMPLAINANT For Petitioners: M/S.T.SUGADEV, Advocate For Respondent : M/S.K.ANBARASAN, Government Advocate(Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused, apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498(A) IPC, seek anticipatory bail. 2.
The case of the prosecution is that the de-facto complainant made a complaint before the respondent police on 25.04.2017 under the dowry harassment. Though the respondent police received a complaint on 27.03.2017, even after one month, they are not taking any action on the complaint made by the de-facto complainant. On 27.04.2017, this Court referred the matter before the Mediation and Conciliation Centre. However, even today the matter is not settled in between the parties.
3.It is admitted that the marriage between the first petitioner and the de-facto complainant was solemnized on 29.05.2015 and thereafter, dispute arose in between them and ultimately, lodged a complaint before the respondent police.
4.The learned Government Advocate (Crl.Side) appearing for the State would submit that petition enquiry is pending. https://hcservices.ecourts.gov.in/hcservices/
5.In view of the above, I am inclined to close this petition with a direction to the respondent police to take a decision on the complaint made by the de-facto complainant and thereafter, follow the procedure as per law.
6.Accordingly, this criminal original petition is closed. sd/- 05/10/2017 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
