O R D E R

The petitioner challenges the order of the first respondent dated 07.01.2025.

2.Heard the learned Counsel for the petitioner and Mr.B.Saravanan, learned Additional Government Pleader appearing for the respondents.

3.Admittedly, the order impugned in the present Writ Petition dated 07.01.2025, is appealable to the Commissioner of Land Administration. Moreover, the petitioner has raised grounds which have to be necessarily tested by reference to various facts and circumstances. This Writ Petition would not be the proper remedy to address the grievances of the writ petitioner. Further, in any event, an appeal is available to the Commissioner of Land Administration. It would be appropriate to the petitioner to avail of the statutory remedy, which would be more efficacious and effective. 2/5

4.In the said circumstances, giving liberty to the petitioner to file an appeal before the Commissioner of Land Administration within a period of four [4] weeks from the date of receipt of a copy of this order, this Writ Petition is disposed of. In the event of the said appeal being preferred within a period of four [4] weeks, then the Commissioner of Land Administration, without putting limitation against the petitioner, shall entertain the appeal and dispose of the same on merits and in accordance with law, after hearing all the interested parties. Registry is directed to return the original order impugned in the Writ Petition, within ten days, getting acknowledgment from the learned Counsel for the petitioner to enable the petitioner to prefer statutory appeal before the Commissioner of Land Administration. There shall be no order as to costs.
