O R D E R

The Writ Petition is filed seeking a direction to the second respondent to issue patta in the name of temple in respect of the property in S.Nos.163,178/4,178/5C, 163/7, 114, 78/5B, 173/8A, 173/5 and 173/6 situated at Kattangulam Village and Mullanvilai, Nattathi Village, Thoothukudi District by considering the Petitioner's representation, dated 20.2.2023 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the petitioner, the properties mentioned in the above mentioned survey numbers were purchased in the name of various persons, who are all the ancestors of the Petitioner and the same has been used as a property of the Karuppasamy temple for several years. Therefore, the Petitioner submitted a representation on 20.2.2023 before the second respondent for issuance of patta in the name of Pillaiyarvilai Karuppasamy temple. The same has not been considered so far. Hence the Petitioner has come to this Court with the present Writ Petition for the relief stated supra.

4.Mr.D.S.Nedunchezian, learned Government Advocate, who appears for the respondents 1 and 2 would submit that properties were purchased in the name of several individuals and therefore, there is difficulty in considering the request of the Petitioner.

5.Even according to the Petitioner, the property was purchased in the name of different individuals, who are all ancestors of the Petitioner and the property has been used as a temple property for several years. Therefore the second respondent can issue notice to all the interested parties and take a decision on the representation submitted by the Petitioner. 6.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the representation of the Petitioner, dated 20.2.2023 and pass final orders on its own merits, after issuing notice to the Petitioner and other interested parties in whose name properties were purchased or their legal representatives, within a period of 16 weeks from the date of a copy of this order.
