THE HONOURABLE MR.JUSTICE P.B.BALAJI Soundarammal ... Petitioner Vs.

2.The Tahsildar, Dindigul East Taluk, Dindigul District.

3.Parvathi 4.Sukumar 5.Lalitha 6.Mohamed Kasim Arkath ... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 1st respondent to cancel the pattas in patta no.4062, 12184 and 14762 by disposing the Enquiry Notice in Na.Ka.No.4167/2023/Aa4, dated 19.11.2024 on the file of the 1st respondent within a time stipulated by this Court.

For Petitioner : Mr.V.Karuna For R1 & R2 : Mr.S.Kameswaran Government Advocate

O R D E R

The petitioner seeks early disposal of the enquiry proceedings pending on the file of the 1st respondent

2. The grievance of the petitioner is that the 2nd respondent has issued patta to respondents 3 to 6 erroneously and the petitioner therefore has preferred an appeal to the first respondent seeking the said patta to be cancelled. It is also the case of the petitioner that the 2nd respondent has recommended cancellation of the patta as sought for by the petitioner. The Village Administrative Officer has also given a report, recommending cancellation of patta. However, the grievance of the petitioner is that, the enquiry is pending on the file of the 1st respondent.

3. The learned Government Advocate would submit that the 1st respondent has already taken up the application of the petitioner and enquiry has been conducted. The learned Government Advocate would further submit 2/4

that the next hearing of the appeal is 28.03.2025.

4. However, I find that after 19.11.2024, there has been no progress. On the petitioner's application. Considering that the application of the petitioner is being enquired into, it would suffice to direct the 1st respondent to conclude the enquiry and pass final orders, on merits and in accordance with law within a period of twelve (12) weeks from the date of next hearing i.e., 28.03.2025.

5. With the above direction, this Writ Petition stands disposed of. No costs.
