For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- To enlarge the petitioner on Anticipatory Bail in the event of his arrest in Cr.No.183 of 2020 pending on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 2.The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under section 420 IPC in Crime No.183 of 2020 on the file of the respondent police, seeks anticipatory bail.

3.The case of the prosecution is that one Arun Kumar gave a sum of Rs.14,50,000/- to the petitioner on 17.02.2020 at about 10.00 a.m, since the petitioner assured that he will return the amount in a higher denomination. The complainant alleges that the petitioner did not stick to his assurance.

4.The learned counsel appearing for the petitioner would claim that there was a financial transaction between the petitioner and one S.K.Sukumar, who is none other than the employer of the defacto complainant.

5.Materials have been enclosed in the typed set of papers indicating the transaction between the petitioner and the said S.K.Sukumar. On going through the contents of the First Information Report, I am of the view that the petitioner's case may be possible; in any event arrest of the petitioner is not necessary. Hence, I am inclined to grant anticipatory bail to the petitioner with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate NO.II, Dindigul, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of eight weeks from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
