O R D E R

The petitioner, who is the respondent in HMOP.No.10 of 2015 filed this petition, to transfer HMOP.No.10 of 2015 from the file of Family Court, Dindigul, to Family Court, Ramanathapuram.

2. The petitioner herein is the wife and the respondent is the husband. The marriage between the petitioner and the respondent was solemnized on 29.08.2010. A male child was born in the wedlock. After marriage, both were living together in the in the matrimonial home. Due to mis-understanding between the petitioner and respondent, the petitioner left the matrimonial home. While so, the respondent filed HMOP.No.10 of 2015, for divorce, on the file of Family Court, Dindigul.

3. Now, the petitioner is staying with her parents at Ramanathapuram. The distance between Ramanathapuram and Dindigul is approximately 300 Kilometers and it is very difficult for the petitioner to travel each and every hearing to attend HMOP.No.10 of 2015, before the Family Court, Dindigul. Further, she is not having any independent income. The petitioner is only depending on her parents for her day-to-day expenses, including the travel expenses.

4. In the circumstances, the petitioner has filed the present petition to transfer HMOP.No.10 of 2015, from the file of Family Court, Dindigul to Family Court, Ramanathapuram.

5. The learned counsel for the respondent submitted that the respondent has no objection to allow this petition and he has also made an endorsement to that effect.

6. *In view of the no objection made by the learned counsel for the respondent, this Transfer Civil Miscellaneous Petition is allowed and H.M.O.P. No.10 of 2015, pending on the file of Family Court, Dindigul ishereby withdrawn and transferred to the file of Principal District

directed to send the case bundles to the Principal District Court, Ramanathapuram, immediately. The Registry is also directed to send back the papers that are pending before the Registry. No costs.
