Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 IPC., in Crime No.1 of 2018, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is liable to pay sum of Rs.1,67,640/- to the defacto complainant as he cheated the said amount through Chit business. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is liable to pay a sum of Rs.46,000/- alone to the defacto complainant and he is willing to deposit the same.

4. The learned Government Advocate (Criminal side) submitted that the investigation is going on.

5. Considering the facts and circumstances of the case, this Court is inclined to grant the relief of anticipatory bail to the petitioner.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Thoothukudi, or to the satisfaction of the respondent police or the police officer, who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation.

7. The petitioner shall deposit a sum of Rs.46,000/- to the credit of Crime No.1 of 2018 on the file of the respondent police within a period of four weeks from the date of receipt of a copy of this order.
