Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the respondents to give police protection to the petitioner and his employees life and limb while in during the agricultural work by considering the petitioner's representation dated 19.04.2017.

ORDER

This Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, praying to direct the respondents 1 and 2 to give police protection to the petitioner and his employees by considering the petitioner's representation, dated 19.04.2017.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents 1 and 2. 3.The learned counsel for the petitioner would submit that the petitioner's brother filed a suit before the Principal District Court, Theni for partition and the same is still pending and by using the said litigation between him and his brothers viz., one https://hcservices.ecourts.gov.in/hcservices/

Pitchai and Karuppiah, made hindrance to the above said properties and they entered into the petitioner's coconut farm and damaged the coconut trees and stolen some of coconuts from that farm.

4.The learned counsel for the petitioner further submitted that the petitioner has given a complaint before the second respondent and CSR receipt has also been given and that the crops are reap for harvesting, but due to the life threat to the employees of the petitioner by the said Karuppiah and Pitchai, the employees refused to come to the agricultural field for doing the said work and therefore the petitioner has given a representation, dated 19.04.2017 to the second respondent seeking for the aforesaid relief.

5.The learned Government Advocate (Criminal Side) submitted that as per the earlier complaint given by the petitioner herein, an enquiry was conducted and closed by the second respondent Police.

6.Considering the facts and circumstances of the case, the second respondent is directed to consider the representation of the petitioner, dated 19.04.2017, according to the merits of the case, and give police protection if necessary. 7.With the above direction, this Criminal Original Petition is ordered.
