Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to dispose the unnumbered appeal filed by the petitioner on 03.12.2021 in a time bound manner. For Petitioner : Mr.V.Selvakumar For R-1 and R-2 : Mrs.S.Jeyapriya, Government Advocate.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the first respondent to dispose the unnumbered appeal filed by the petitioner on 03.12.2021 within a time frame to be fixed by this Court.

2. The petitioner claims to have filed a statutory appeal on 03.12.2021 aggrieved by the issuance of computer chitta vide Patta No.283 by the second respondent. The petitioner seeks for numbering of the statutory appeal and for early disposal of the said statutory appeal in this Writ Petition.

3. Heard Mr.V.Selvakumar, learned counsel for the petitioner and Mrs.S.Jeyapriya, learned Government Advocate, who accepts notice on behalf of the first and second respondents. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned Government Advocate, on instructions, would submit that no such appeal, as claimed by the petitioner, has been received by the first respondent. She would submit that, if the petitioner files a regular appeal before the first respondent aggrieved by the issuance of computer chitta, the same will be considered by the first respondent on merits and in accordance with law.

5. Learned counsel for the petitioner agrees to the submission made by the learned Government Advocate and would submit that the petitioner is willing to file a fresh statutory appeal before the first respondent. The said statement is recorded.

6. For the foregoing reasons, this Court directs the petitioner to file a fresh statutory appeal aggrieved by the issuance of computer chitta vide Patta No.283 before the first respondent within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said statutory appeal and if it otherwise in order, the first respondent shall pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner within a period of four (4) months thereafter.

7. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
