For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime.No.374 of 2020 on the file of the Respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 465, 468, 484, 488, 188, 202 and 109 of I.P.C., in Crime No.374 of 2020 on the file of the respondent police, seeks anticipatory bail.
3. The learned Government Advocate (Crl.side) states that the case involves preparing of fake transit e-passes during this pandemic period and the petitioner's earlier petition for anticipatory bail suffered dismissal and that there is no change in circumstances.
4. The learned counsel for the petitioner points out that A2 to A4 are drivers, who had used bogus vehicle e-passes and under the erroneous impression that the petitioner is the brother of A2, he has been falsely implicated. The petitioner's counsel states that the investigation by the police reveals that one Ashok, who is running a computer centre, had actually fabricated the e-passes. The petitioner's counsel claims that the petitioner's wife is now 9 months pregnant and their marriage is love marriage and there is no one to look after her, if the petitioner is arrested. He undertakes that the petitioner will co-operate with the investigation.
5. Recording the said undertaking of the petitioner to cooperate with the investigation, I am inclined to grant anticipatory https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.6005 of 2020 bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Cheranmadevi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of eight weeks from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
